Terms & Conditions
These Terms & Conditions apply to the use of the artificial-intelligence-based technology platform of Analítica de Talentos EIRL, with RUC 20611654481 (hereinafter, “the Company”). These terms are applicable and legally enforceable in Peru, Colombia, Chile, Brazil, Argentina, Ecuador and Mexico.
1. Purpose
The Company’s technological platform enables clients to integrate, query and analyze information from various data sources, including credit bureaus of external providers contracted by the clients, as well as other sources the clients wish to integrate.
2. Nature of the Platform
The offered solution is an AI-based support tool that extracts, processes and organizes information from different data sources. The platform does not issue value judgments but evaluates whether the data of individuals or companies comply with the evaluation rules defined or designed by each client.
3. Use of Data
The data from the evaluations, as well as the information of individuals and companies consulted, may be used by the Company in anonymized and aggregated form for the purpose of generating historical information. This information may be used to create analytical decision models that allow clients to gain visibility over which rules and models could work best according to the objectives they define.
4. Client’s Responsibility
The client is solely responsible for:
Engaging and enabling the external data providers they consider appropriate.
Designing, selecting and configuring the evaluation rules they wish to apply in the platform.
Verifying the truthfulness and legality of the data they integrate into the platform.
Complying with the local data protection regulations in their country of operation.
5. Limitations of Artificial Intelligence
The AI used in the platform has inherent limitations. The results of the analyses do not constitute legal, financial, labor or any other kind of advice, and should not be interpreted as a definitive decision. The Company does not guarantee absolute accuracy or suitability of the results for specific purposes, with the client being responsible for decisions they make based on such results.
6. Intellectual Property
All intellectual property rights over the platform, algorithms, models and documentation belong to the Company. The client is granted only a limited, non-exclusive, non-transferable license to use the platform under these Terms & Conditions.
7. Confidentiality
The Company commits to maintain the confidentiality of the information accessed through the platform, except in cases where it is necessary for compliance with legal or contractual obligations, or when the data are used in anonymized and aggregated form for purposes of improving analytical models.
8. Regulatory Compliance
The client acknowledges and accepts that it is their exclusive responsibility to ensure compliance with the laws and regulations applicable in Peru, Colombia, Chile, Brazil, Argentina, Ecuador and Mexico, including, but not limited to, personal data protection laws and laws on access to credit information.
9. Limitation of Liability
The Company shall not be liable for direct, indirect, incidental or consequential damages arising from the use or inability to use the platform, including but not limited to loss of data, loss of profits, business interruption or any other harm derived.
10. Amendments
The Company reserves the right to modify these Terms & Conditions at any time. The amendments will be notified to clients and will be deemed accepted through continued use of the platform.
11. Governing Law and Jurisdiction
These Terms & Conditions shall be governed by the laws of the Republic of Peru. For any dispute arising from the interpretation or execution of these terms, the parties submit to the jurisdiction of the courts of Lima, Peru, without prejudice to the Company being able to pursue actions in the countries where the clients operate.
